Kushtunes respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid takedown notices.

Reporting Copyright Infringement

If you believe that your copyrighted work has been used in a way that constitutes copyright infringement, please provide our designated copyright agent with the following information:

• A physical or electronic signature of the copyright owner or authorized representative
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing and information sufficient to locate it
• Contact information including name, address, telephone number, and email address
• A statement that you have a good faith belief that use of the material is not authorized
• A statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

DMCA Takedown Process

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification. Your counter-notification must include:

• Your physical or electronic signature
• Identification of the material that was removed and its location before removal
• A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
• Your name, address, and telephone number
• A statement consenting to the jurisdiction of the federal court in your district

Repeat Infringer Policy

Kushtunes will terminate accounts of users who are repeat infringers. A user is considered a repeat infringer if they have been notified of infringing activity more than twice and/or have had infringing material removed from our service more than twice.

False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

Alternative Dispute Resolution

Before filing a DMCA takedown notice, we encourage you to contact the user directly to resolve the issue. Many copyright disputes can be resolved through direct communication.

If direct communication fails, you may also consider alternative dispute resolution methods such as mediation or arbitration before pursuing legal action.
